    • In the name of God – Amen – I, Joseph Rogers, of Robberson Township in Greene County State of Missouri being mindful of the mortality of my body, do make and publish this my last will and testament, in manner and form following, that is to say;
      First. I give devise and bequeath my beloved wife Nancy Rogers all my lands, that is the lands and plantation on and near which we now live, containing about two hundred acres, also the North East quarter of Section number [TORN OUT] four in Township Thirty one of Range Twenty one containing one hundred [TORN OUT] acres worth all the improvements that is to say all the buildings and farm attached to or about it during her natural life also all my personal property whatsoever and wheresoever of what nature and quality soever the same may be (after the payment of my debts and funeral expenses) I do give and bequeath to my aforesaid wife Nancy Rogers during her natural life and that at the death of my said wife all my lands as above described and so much of the personal property as may then remain unexpended to be equally divided or sold and the money equally divided between or amongst my sons James M. Rogers, William C. Rogers, Greenberry Rogers, John H. Rogers, Samuel E. Rogers, Thomas J. Rogers, and Hosea M. Rogers, and my daughter Martha E. Rogers, shall have property or money before the division is made equal in amount to what I have given my other children, provided also, that if my said wife Nancy Rogers should at any time marry that at her remarriage she shall be entitled to hold only her legal dower of said Land and an equal portion of personal estate with my before named children. And lastly I hereby constitute and appoint my sons James M. Rogers and William G. Rogers to be the Executors to this my last will and testament. In testimony whereof I have hereunto set my hand and seal this second day of May in the year of our Lord One Thousand Eight hundred and fifty one.

    Sheriff's sale 
    • Land description: East ½ NE ¼ Section 24, Township 31, Range 21 (400 acres), 160 acres for which he obtained through pre-emption 11/21/1845 (NE1/4 of TWP 31N Range 21W).


      Know all men by these presents that I Samuel Fulbright of the County of Greene and State of Missouri send greeting whereas on the 18th day of July in the year of our Lord eighteen hundred and fifty four an order was made by the Honorable Judge of Greene Circuit Court at the July term A D 1854 for the sale of the real estate of Joseph Rodgers deceased for the purpose of partition and distribution. And whereas on the day of A D 185[_] said order was placed in my hands as sheriff as aforesaid which order commanded me to sell said real a state at the court house door in the town of Springfield in said County of Greene at the Court house door during the sitting of said court and in pursuance of law and and by virtue of authority in me vested I as Sheriff as aforesaid causes said real estate to be advertised in the weekly Springfield Advertiser a weekly newspaper printed in the Town of Springfield in said County of Greene, giving sixty days notice specifying the time place and maner of sale what real estate was to be sold and where situated which real estate is described as follows to wit North East qr of Section 24 East half of South East qr of section fourteen and North West qr of South East quarter of Section no. four fourteen, and West half of South West quarter of Section thirteen all in Township Twenty one of Range Twenty One. And in pursuance of said order and advertisements I did on the Twenty fifth day of March AD 1855 whilst the Circuit Court was in session for said County during the lawful hours of said day expose said real estate to sale in legal subdivisions on a credit of twelve months and Greenebery Rodgers being the highest best and last bidder for the following portion of said real estate to wit the East half of the North East qr of section Twenty four Township Thirty one of range twenty one. The same was stricken off to him at and for the sum of eight hundred dollars the same being two dollars per acre.

      Now therefore know ye that in consideration of the premises and of the said sum of eight hundred dollars to me paid the receipt whereof I do hereby acknowledge, I hereby bargain grant sell and by these presents do hereby bargain grant sell and convey unto the said Greeneberry Rodgers the said purchaser all the right title interest and claim that the said decedent had in and to the above described real estate to have and to hold the same together with all and singular the appurtenances thereunto belonging or in any wise appertaining thereunto in as full a maner as I as Sheriff has a right to convey by virtue of authority in me vested.

      Know all men by these presents that I Samuel Fulbright Sheriff of the county of Greene and state of Missouri send greeting.

      Whereas on the 18th day of July AD 1854 an order was made by the Honorable Judge of the Circuit Court of the County of Greene at the Term of said court for the sale of the real estate of Joseph Rogers Deceased for the purpose of Partition and Distribution and whereas a copy of said order was placed in my hands by the Clerk of the Circuit Court for said County which order commanded me to sell the real estate of said deceased at the Court House door in the Town of Springfield in said county during the sitting of the Circuit Court for said county during or one day the said Term of said Court.

      And in pursuance of law and by virtue of authority in me vested as sheriff as aforesaid I caused said real estate to be advertised for sixty days as the law directs in the weekly Springfield advertiser a weekly newspaper printed in said county of Greene which said advertisement specified the Time Terms Place and Manner of said sale and of what real estate was to be sold and where situated which is described as follows to wit:

      North West qr Section Twenty four- East half of South East qr of Section Fourteen and North West qr of South East quarter of Section No Fourteen West half of South West quarter of Section Thirteen – all in Township Thirty one of Range Twenty one.

      And in pursuance of law and by virtue of authority in me vest3ed I did on the Twelfth day of March AD 1855 while the Circuit Court for said County was in session and during the lawful hours of said day expose said real estate to sale in legal subdivisions and on a credit of Twelve months and C S Wallis being the highest best and last bidder at public vendue the following portion of said real estate to wit East half of South East quarter of Section Fourteen & North West quarter of South East quarter of Section Fourteen and West half of South West quarter of Section Thirteen Township Thirty one Range Twenty one containing two hundred acres the same was stricken off to him at and for the sum of Seventeen hundred dollars.

      Now there fore Know ye that in consideration of the premises and of the sum of seventeen hundred dollars to me in hand paid the receipt whereof is hereby acknowledged I hereby bargain grant sell and by these presents do hereby bargain grant sell and convey unto the said C S Wallis the said purchases all the right title interest and claim that the said Joseph Rogers the said deceased had in and to the above described real estate.

      To have and to hold the same together with all and singular the premises and appurtenances thereto belonging to the above bargained and granted premises unto the said C S Wallis and to his heirs and assigns forever to their own use and benefit in as free and ample a manner as I as Sheriff by virtue of authority in me vested have a right to convey the same.

      In testimony whereof I have hereto set my hand and seal this 5th day of March AD 1858
